Text may be submitted on disk, FTP or emailed to PEK Interactive, Inc in standard PC word processing format. PEK Interactive reserves the right to not use your text. Photos and graphics any of the standard graphic formats may be submitted to PEK Interactive, Inc on disk, FTP or emailed directly to PEK Interactive, Inc. Paper format should be the highest quality artwork or photos available for PEK Interactive, Inc to scan. Make sure your originals are clear and clean. PEK Interactive, Inc will resize your graphics to conform to your web page. PEK Interactive reserves the right to not use your graphics.

Hosting and Domain Name

Web site hosting and domain name will be purchased on behalf of client through our in-house servers or our partners. Web site hosting and domain name will be for a period of one calendar year from time of purchase. PEK Interactive, Inc will register clients name and address as the administrative contact/owner of domain. After completion of first year it is the clients responsibility to renew their contract. Warning of account expiry will be sent via email to client. It is clients responsibility to comply with all PEK Interactive policies. Hosting and domain name cannot be redeemed for cash or other services/products.

Data Backup

Whilst PEK Interactive, Inc shall use its reasonable endeavor to ensure that backup copies of the Web Site and all Client data contained in the Web Site are made, the Client shall be solely responsible for the backup of such data and PEK Interactive, Inc shall not be liable for any damages, loss, costs or other expenses arising out of or in connection with any loss of data by the Client which are due to the failure of the Client or PEK Interactive, Inc, or its partners to back up such data after site completion.

No Liability for Consequential Damages

Neither PEK Interactive, Inc nor anyone else who has been involved in the creation, production, or delivery of the website shall be liable to the client or any third party for any direct, indirect, special, consequential, or incidental damages (including but not limited to damages for the loss of profits or savings, downtime, business interruption, loss of business information, damage to or replacement of equipment and property, recovery or replacement of programs or data, or other pecuniary loss) arising out of the use, the results of use, or inability to use the website services, even if PEK Interactive, Inc has been advised of the possibility of such damages or claim. This Agreement is governed by the laws of the California, USA. If for any reason a court of competent jurisdiction finds any provision of this license, or portion thereof, to be unenforceable, that provision of the license shall be enforced to the maximum extent permissible so as to effect the intent of the parties, and the remainder of this license shall continue in full force and effect. Each of the parties hereto irrevocably attorns to the jurisdiction of the courts of the California, USA and further agrees to commence any litigation which may arise hereunder in the courts located in the San Diego of California, USA.

Force Majeure - “Greater Force”

Neither party shall be liable for any delay in performing or failure to perform its obligations hereunder to the extent that and for so long as the delay or failure results from any cause or circumstance whatsoever beyond its reasonable control (an “event of force majeure”), provided the same arises without the fault or negligence of such party and the affected party notifies the other party within three (3) working days of becoming aware of the same of such event of force majeure and the manner and extent to which its obligations are likely to be prevented or delayed, and provided also that the occurrence of any such event of force majeure shall not have the effect of discharging or postponing the affected party’s payment obligations hereunder.
